Terms and conditions of service and data processing

General conditions

a) By accepting these “Terms and Conditions” you are stipulating a contract with the company Viagoparking – Verbena Servizi SAS, which has as its object the deposit of the car at our parking structure for the agreed period and the free transport of people and luggage to and from port and airport. Additional services included in the offer may also be agreed with the customer.

b) Payment for the service must be paid locally upon delivery of the vehicle according to the agreed rates. The vehicle can be returned upon presentation of the receipt.

c) The car keys must be handed over to the personnel in charge in order to provide for the suitable accommodation of the car in the established area.

d) This deposit may take place on the customer’s choice and within the limits of the availability of places, in covered or uncovered areas. By “covered” we mean sheds and sheds, also open to the sides. The cars could be parked temporarily, for a few hours, in the open, even if covered, waiting to be placed in the reserved place. They may also be temporarily moved out into the open if and whenever the need arises, for example for preparation for the return date and other logistical needs.

e) In case of entry before the booked time or exit after the deadline in the order of 4 hours, the price will be increased accordingly.

f) Viagoparking – Verbena Servizi SAS is only liable for the total theft of the vehicle and limited to its commercial value. It is also liable for the partial or total theft of accessories which constitute essential elements of the vehicle.

g) All items that have no functional and continuous link with the goods are expressly excluded from the refund (for example: clothing, jewellery, glasses, cash or other valuables, mobile phones and accessories, palmtops, similar devices and accessories , tablets, camcorders, cameras and accessories, satellite navigators, audio-video players and accessories, fountain pens, ballpoint pens and the like, remote controls not related to the use of the car, compact disks, computers, key rings, house keys, and more valuable asset.

h) With regard to damage to the car, the company Viagoparking – Verbena Servizi SAS is liable within the limits of the liability attributable to the work of its employees during the movements and not for damage caused by customers and third parties.

i) Viagoparking – Verbena Servizi SAS is not liable for damage and/or breakdowns to vehicles of a mechanical or electronic nature which do not depend on the movement of the cars but on their poor maintenance or unforeseeable circumstances and in no case for damage deriving from atmospheric events or for indoor or outdoor seating. Any damage to the vehicle or complaints must be immediately reported to the staff upon collection of the vehicle. The company will not be responsible for damages or posthumous disputes upon exiting the car park.

j) The above conditions are also accepted pursuant to art. 1341 and 1342 of the Civil Code.

k) The Court of Rome will be exclusively competent to decide any dispute concerning the validity, interpretation and execution of these General Conditions.

Privacy

Pursuant to art. 13 of the legislative decree n. 196 of 06.30.2003 (“Code regarding the protection of personal data”), we inform you of the following:

1) Your personal data is collected, recorded, sorted and stored exclusively for the purposes related to the fulfillment of legal obligations, the performance of activities relating to the conclusion, execution, management of the contact, the processing of electronic / paper correspondence

2) The processing of data carried out both by manual tools and by IT tools and procedures, in any case suitable for guaranteeing security and avoiding unauthorized access, in compliance with the security measures referred to in the Technical Regulations annex B of the Privacy Code .

3) The provision of the data in question is optional, however any refusal to respond will make it impossible to stipulate the contract and to fulfill legal obligations, including tax obligations.

4) The above data may be communicated, exclusively for the purposes referred to in point 1, to the categories of subjects listed below: accountant firms, professional firms, law firms, banks, Public Authorities and Public Administrations for the fulfillment of law, agents and business brokers, parent companies, associates, subsidiaries, companies with which we have commercial relations;

5) The data is stored at our headquarters for a time not less than that prescribed by civil and fiscal regulations and cannot be disseminated.

6) Article 7 of Legislative Decree n.196 of 06.30.2003 recognizes certain rights to the interested party, including the right that can be exercised at any time, to obtain confirmation of the existence or not of personal data concerning him, to know the content and origin, verify its accuracy or request its updating, rectification and, when interested, integration.

Pursuant to the same article, the interested party has the right to request cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as to oppose in any case, for legitimate reasons, the processing.
